SARL Chamonix All Year – Terms and Conditions for the Resort Shop

 

The English version of the T's & C's is provided for your information. The legally binding terms and conditions is the French version. 

The services presented on the website www.chamonixresortshop.com and in the shop are offered by SARL Chamonix All year on behalf of its partners. 


SARL Chamonix All Year is a Society with Limited Responsibility (Société à Responsabilité Limitée) registered at 91 chemin des Lupins, 74400 Chamonix, registered with the Chamber of Commerce of Annecy, SIRET 524 146 842 (TVA: FR19524146842).

Chamonix All Year offers, on behalf of its partners, services, in particular: Provision of products and/or services of sports equipment rental, organising outings in the Chamonix valley, transport, lift passes, insurance…

These products and/or services will be offered via the website www.chamonixresortshop.com

1.1 Definitions

“SARL CAY” refers to SARL Chamonix All Year.
“The Shop” refers to the website www.chamonixresortshop.com edited by Chamonix All Year.
“Order” refers to any booking made and confirmed by the user on the Shop. 
“Specific Conditions” refers to the service-specific contract conditions – available on the site before confirmation of any order (Specific terms and conditions for the rental of sports equipment in winter and in summer; Specific terms and conditions for the booking of products and services; Conditions applicable to transport).
“Terms and conditions” refers to the conditions presented as general conditions of sale. 
SARL CAY acts as an “agent” intermediary for the supply of products and/or services booked by the Client(s) with its partners. These products and/or services will be provided by the intermediary on the website of the SARL CAY Shop. 
“Partner(s)” refers to any service provider. The term “Partner” includes equipment hire shops, tour operators, guide companies, etc. 
“Service” refers to a provision of service, such as the provision of equipment to hire, of transport, of insurance etc.
“You” or “the User” or “the Client” refers to any person using the Shop, including to book, order and/or buy any service offers by the Shop on behalf of its Partners. 

1.2 Scope

These general terms and conditions of sale and use (hereinafter “Terms and Conditions”), as well as the Specific Conditions which apply to each service, apply to any use of the Shop. 

1.3 Use of the Shop

Terms of Use

Placing an Order for Services is reserved for Users who have read and accepted the present Terms and Conditions in their entirety, as well as the Specific Conditions for each Service, before each order, either by a click or, where appropriate, by telephone.
To use the Shop, you must be at least 18 years old, and be legally able to enter into and use the Shop according to the Terms and Conditions. 

You are financially responsible for the use of the Shop, both on your behalf and on behalf of third parties, including minors, except in cases of fraudulent use resulting from no fault or negligence on your part. 
You guarantee the truth and accuracy of all information provided by you or any third party using your details on the Shop. 
Fraudulent use of the booking service on the Shop or use which is contrary to the Terms and Conditions, may lead to Chamonix All Year’s refusal to allow you access to the Services offered on the Shop.

Placing an order

You may order Services available on the Shop, after accepting the present Terms and Conditions as well as the Specific Conditions. 
The process for placing an Order includes at least the following steps:
1. You carry out a search
2. Following your request, the Shop will suggest one or more Service suggestions.
3. Click on one or more Services of your choice. 
4. A summary of all of your choices and the total price of the Services allows you to check the detail of your Order
5. You must therefore ensure that all the information is displayed according to your specifications (date, time, address, price, identity, age, etc.); they cannot be changed after confirmation of your Order.
6. You can then confirm your Order, subject to prior acceptance of the present Terms and Conditions and the Specific Conditions which apply.
7. You pay for your order securely online (up to 4 days before the date of the Service to be provided). 
8. The contract is thus finalised. 
9. Chamonix All Year, on behalf of its partners, will send you by email an acknowledgement of your Order as soon as possible, and at most within the five days following your Order, which will include the essential elements of your Order such as the Service ordered, the price and the quantity.
All the details in this Order acknowledgement will be deemed to constitute the elements of your Order, unless you dispute them by registered letter within 8 days from the receipt of the Order acknowledgement. They can only be disputed if they differ from the Order which you have placed. 
10. In the event that you do not receive an Order acknowledgement within five days, it is your responsibility to contact Chamonix All Year, either by telephone on +33 (0) 4 81 68 01 04 or by email at relax@chamonixallyear.com, or in writing to Chamonix All Year, 91 chemin des Lupins, 74400 Chamonix. 
11. Following that, you will receive an email confirmation of your Order. Insofar as the Services are subject to our Partners’ availability, the Order is not firm and final as it has not been subject to a confirmation by SARL CAY. 
SARL CAY commits to confirm availability to you 72 hours before the actual start of the Service, at the latest. 
12. In any case, it is your responsibility to ensure that the all the information (identity, email address, postal address etc.) that you provide with your Order is correct, and to inform Chamonix All Year immediately of any changes which may affect them, so that they can ensure that you receive the Services that you have ordered, either by telephone on +33 (0) 4 81 68 01 04 or by email at relax@chamonixallyear.com, or in writing to Chamonix All Year, 91 chemin des Lupins, 74400 Chamonix.

1.4 Prices

The sale price is agreed at the time of booking. 
If the sale price which appears on the site has to be changed, only the price shown at the time of the moment of concluding the contract applies. 
The sale price is that which is charged by the Shop and may be different from the Partner’s recommended retail price. 

1.5 Payment

Total payment must be made at least 4 days before the start of the Service. 
Failure to observe this condition will result in the automatic cancellation of the booking. 
However, for special offers, other payment deadlines may apply. 
This deadline will therefore be clearly stated on the special offer. 

1.6 Right of withdrawal

You are informed that, pursuant to Article L. 121-20-4 of the Consumer Code , all Services proposed by the Shop on behalf of its Partners, which are not equipment rental, are not subject to the application of the right of withdrawal provided for in Articles L 121-20 of the Consumer Code on distance selling.
As a result, leisure Services ordered on the Shop are only subject to the cancellation and modification conditions in the present Terms and Conditions and/or Specific Conditions which apply. 
For the equipment rental Service, you have a legal withdrawal period of 7 days from the Client’s receipt of the email confirmation of the Order. 
If this period ends on a Saturday, Sunday or holiday, the period is extended to the next business day. However this right of withdrawal cannot be exercised if you have already collected the equipment reserved before the 7-day period ends. 

1.7 Cancellation

Please refer to the Specific Conditions which apply to each Partner. 

1.8 Ability to provide the Services

Chamonix All Year draws your attention to the fact that certain Services offered by Chamonix All Year’s partners and which are available on the Shop may be cancelled, for reasons including adverse weather, force majeur, bookings out of peak seasons, or where the number of participants required for an activity to run has not been reached. 
In that event, Chamonix All year cannot be held responsible. 
Chamonix All Year can, if you wish, seek an alternative solution, which may involve additional cost. 
As a result of the above, only the Terms and Conditions of the Partners will apply to these Services.

1.8 Ability to provide the Services
Chamonix All Year draws your attention to the fact that certain Services offered by Chamonix All Year’s partners and which are available on the Shop may be cancelled, for reasons including adverse weather, force majeur, bookings out of peak seasons, or where the number of participants required for an activity to run has not been reached. 
In that event, Chamonix All year cannot be held responsible. 
Chamonix All Year can, if you wish, seek an alternative solution, which may involve additional cost. 
As a result of the above, only the Terms and Conditions of the Partners will apply to these Services.

1.9 Information and Complaints

All requests of information, details and Order tracking should be made to:

Complaints should be confirmed in writing by registered post within 14 days of the client’s departure to the following address:

Complaints can only be taken into consideration if this procedure is followed. 
SARL CAY will endeavour to respond within 30 days. 

1.10 Data protection

The information which you provide on the Shop allows Chamonix All Year and its Partners to process and fulfil the Orders submitted on the Shop. 
Chamonix All Year undertakes to protect these data under the conditions set out under the “Security – confidentiality” section of the Site. 

1.11 Licence to access the site

Chamonix All Year holds all intellectual property rights relating to the Shop. 
Access to the Shop does not confer any right to the intellectual property rights relating to the Shop, which remain the exclusive property of Chamonix All Year or its Partners. 
The elements available on the Shop , particularly in the form of text, photographs , images, icons, maps, sounds , videos, software, databases, and  data are also protected by intellectual and industrial property rights and other proprietary rights which Chamonix All Year holds.
Under no circumstances may you reproduce, modify, transmit, publish or adapt, on any medium whatsoever or by any means whatsoever, or exploit in any manner whatsoever, all or part of the Shop without the prior written consent of Chamonix All Year. 
Any use which is unauthorised by Chamonix All year, in any capacity whatsoever, of all or part of the Shop will be subject to appropriate action, including action for infringement. 

1.12 Governing Law and Jurisdiction

The present Terms and Conditions, and more generally the contract which you have concluded with Chamonix All Year via the Shop are subject to French law. 
Any dispute relating to their interpretation and/or their execution should be raised in the French courts.

1.13 Final Provisions

In the event that any provision of the Terms and Conditions is declared null or void, it shall be deemed unwritten, without affecting the validity of the other provisions, unless the provision deemed null and void  was essential and decisive. 
All cases of force majeure which prevent the execution of the Service, including the interruption of means of communication removes the obligation on Chamonix All Year affected by the force majeur. 
Failure to carry out Services will not lead to damages or interest being paid.
Chamonix All Year reserves the right to modify these Terms and Conditions. 
If the Terms and Conditions change after an order is placed, the conditions in place at the time of the Order will still apply.
